  • "1st Circuit reverses 31-year-old precedent on Clean Water Act citizen suits," Massachusetts Lawyers Weekly (May 9). MBA member Jeffrey R. Porter commented on a First Circuit U.S. Court of Appeals decision that a limitation on citizen suits over alleged ongoing violations of the Clean Water Act applies only to suits seeking civil penalties and not declaratory or prospective injunctive relief.

  • "SJC finds no coverage for fire damage to historic building," Massachusetts Lawyers Weekly (May 9). MBA member Michael F. Aylward discussed a Supreme Judicial Court decision that a general liability policy for losses related to a motel did not cover fire damage caused by workers renovating a different property that the policyholder was in the process of purchasing.

  • "Pain and suffering award for nursing home death vacated," Massachusetts Lawyers Weekly (May 9). MBA members Kevin D. Withers, Joseph M. Desmond and Johanna L. Matloff commented on a Superior Court judge's decision vacating an award for conscious pain and suffering by a resident in a long-term care facility who died of apparent head trauma because his personal representative brought the claim more than three years after his death.
