  • "Appeals Court upholds $2.5M gross negligence verdict," Massachusetts Lawyers Weekly (March 9). MBA Past President Jeffrey N. Catalano and MBA member Marc L. Breakstone discussed a recent Appeals Court decision upholding a jury finding of gross negligence in connection with the death of a patient whose surgeon allegedly ignored an important manufacturer's warning.

  • "1st Circuit reinstates ERISA plan’s denial of death benefits," Massachusetts Lawyers Weekly (March 9). MBA member Johanna L. Matloff commented on a decision by the U.S. Court of Appeals for the First Circuit, which found that an insurance carrier did not abuse its discretion by denying a widow's claim for accidental death benefits after her husband died in a car crash that had been attributed to a pre-existing condition.
