Best Practices for Advocates in Mediation

Businesses and individuals increasingly want their disputes resolved as
efficiently and economically as possible. Counsel representing clients in litigation face many strategic choices in how best to achieve this result. Mediation provides a private setting to work on a party-driven, non-dictated, mutually agreed business or personal resolution facilitated by a skillful neutral. Mediating potentially saves time and money and allows for creative solutions that would not be possible in a winner-take-all trial.

This program will cover how counsel representing clients in litigation can use mediation to their client’s advantage including:

• Deciding whether mediation is the preferred process for the dispute
• Determine how to get to the mediation table
• Selecting a mediator-expertise and process skills
• Engaging in pre-mediation conference calls and meetings
• Preparing for a successful mediation
• Presenting your best case in mediation
• Closing the deal
• Enforcing the settlement agreement

WHO SHOULD ATTEND — Advocates/Lawyers who represent clients in
litigation, In-House Counsel, Mediators and Arbitrators.
