During the past two decades, the U.S. Department of Justice (DOJ) has filed a plethora of civil rights actions in the federal courts seeking police reform against cities and counties across the nation. These civil rights actions are brought under the Violent Crime Control and Law Enforcement Act of 119, 42 U.S.C. sec. 14141, which makes it unlawful for any governmental authority, agent or any person acting on behalf of governmental authority to engage in a pattern or practice of conduct by law enforcement officers that deprives persons or rights, privileges or immunities secured by the U.S. Constitution and law of the United States.

Section 14141 actions usually result in agreements between the DOJ and the defendant governmental entity. These agreements provide for reform in multiple areas, including:

  • Excessive force
  • Unreasonable searches and seizures
  • Discriminatory policing
  • Illegal detentions
  • False arrests

The Honorable Gustavo A. Gelpi will share his experiences, challenges, and thoughts on police reform in the hopes it will benefit his colleagues, the DOJ, and police department attorneys.
