  • "Dissent: 1st Circuit improperly ‘flipped script’ on Delta flight attendant," Massachusetts Lawyers Weekly (Sept. 9). MBA Labor & Employment Section Council Chair Valerie C. Samuels, Labor & Employment Section Council member Kathleen A. Berney and MBA member Rebecca G. Pontikes discussed a potential en banc review of a 1st U.S. Circuit Court of Appeals panel decision to uphold summary judgment for Delta in a case involving a flight attendant's claim that a co-worker drugged and sexually assaulted her.

Barach commented on an Appeals Court decision that a Probate and Family Court judge erred in issuing a divorce judgment that deviated from the presumptive alimony durational limit by ordering the husband to make potentially lifetime payments to his ex-wife.

  • "SJC hones in on questionable eyewitness identifications," Massachusetts Lawyers Weekly (Sept. 9). MBA Criminal Justice Section Council member D. Christopher Dearborn and MBA member Ira L. Gant discussed a Supreme Judicial Court decision establishing that advances in the science of eyewitness identification may constitute newly discovered evidence in support of claims for post-conviction relief.
