  • "ADA ‘tester’ can sue over website’s non-compliance," Massachusetts Lawyers Weekly (Oct. 17). MBA President Grace V.B. Garcia discussed a First U.S. Circuit Court of Appeals decision that a plaintiff could sue a hotel whose website allegedly failed to meet federal requirements governing accessibility for people with disabilities, even though she did not intend to make a reservation.

  • "Employee’s widow can bring ‘functional’ fiduciary claim vs. insurer," Massachusetts Lawyers Weekly (Oct. 17). MBA member Alden J. Bianchi commented on a First U.S. Circuit Court of Appeals decision that a widow could bring a breach-of-fiduciary claim under the Employee Retirement Income Security Act against an insurer that allegedly collected 10 years of premiums without ever verifying her husband's eligibility for coverage.
