Notice inviting comment on proposed amendments to Rule 55 of the Mass. Rules of Civil Procedure

The Standing Advisory Committee on the Rules of Civil Procedure (SAC) solicits comments on proposed amendments to Mass. R. Civ. P. 55, Default. The amendments would revise Rule 55(b)(4) to make its requirements consistent with the federal Servicemembers Civil Relief Act, 50 U.S.C. § 3901 et seq. The proposed language more closely tracks the federal statutory language and requires that affidavits include additional information regarding whether a defendant is in military service.                    

The proposed amendments and reporter's notes appear here. Comments should be directed to Christine P. Burak, Supreme Judicial Court, John Adams Courthouse, One Pemberton Square, Boston, MA  02108 on or before Aug. 16, 2019. Comments may also be emailed to christine.burak@sjc.state.ma.us. Comments received will be made available to the public.
