Comments sought on proposed amendment to Mass. R. Crim. P. 15(a)(3)

The SJC Standing Advisory Committee on the Rules of Criminal Procedure invites comments on a proposed amendment to Mass. R. Crim. P. 15(a)(3).

The committee previously proposed deleting Rule 15(a)(3) as that provision no longer reflects the law and now proposes a new Rule 15(a)(3) that would permit the commonwealth to appeal a judge's decision under G.L. c. 119, § 72A, to discharge from criminal prosecution a juvenile defendant who, by virtue of his or her age, is no longer subject to Juvenile Court jurisdiction.

Comments, which will be made available to the public, are due by September 1, and should be directed to SJC Senior Attorney Barbara Berenson.
