Bail statute
"I agree there is a certain level of frustration out there, but
in terms of such a widespread change to the bail statute throughout
the commonwealth, I don't see a lot of that advocacy."
MBA Chief Legal Counsel and
Chief Operating Officer Martin W. Healy, The Republican/MassLive.com, October
20
Healy was quoted in a story about a bill (HD.4161) that would allow prosecutors to appeal
a bail ruling. Under current law, a defendant can appeal to a
Superior Court judge when bail is set by a District Court judge.
Prosecuting attorneys cannot appeal bail. "I don't see a
groundswell yet of support for change to the bail statute," added
Healy.
