Public Lands Issue: What’s New with Article 97?

What is the status of Article 97 now that the SJC has spoken in Mahajan v. DEP? When are public lands subject to being classified as Article 97 property and what proposed actions trigger Article 97’s requirements for a two-thirds vote of the legislature?

The Massachusetts Bar Association’s Public Law Section Council is sponsoring this lunch-time program where a panel of attorneys will focus on recent developments in Article 97 interpretation of last year’s SJC decision in Mahajan. This promises to be a timely and thought provoking look at one of the Commonwealth’s most important legal provisions restricting the utilization of public lands.

If you are municipal or state agency counsel or a practitioner representing land developers and environmental groups, you are encouraged to attend and ask questions and exchange ideas with the panelists, all of whom have had significant litigation experience related to the interpretation of Article 97.
